This Insurance & Liability Disclaimer outlines the legal responsibilities and limitations of KobiCare (operated by Protreon Inc.) regarding incidents, damages, or losses that may occur before, during, or after the use of our services. By using the KobiCare platform, you acknowledge and agree to the terms described herein.
1. Platform Role & Limited Responsibility
- KobiCare is a technology platform that connects independent caregivers with families and pet owners.
- KobiCare does not directly provide caregiving services and is not responsible for the actions, conduct, or omissions of caregivers or clients.
- All caregivers operate as independent contractors and are not employees, partners, or agents of KobiCare or Protreon Inc.
2. No Insurance Provided
- KobiCare does not provide liability, medical, health, renters, or pet insurance coverage to users of the platform.
- Any damages, injuries, or losses that occur during a caregiving engagement are the sole responsibility of the caregiver and/or client.
- Caregivers are strongly encouraged to obtain general liability insurance or pet sitter/babysitter insurance as appropriate.
3. User Responsibility & Assumption of Risk
- By using KobiCare, you assume full responsibility and risk for all interactions and services arranged through the platform.
- You agree to take reasonable precautions when selecting a caregiver or client, including conducting interviews and vetting as needed.
- You release KobiCare and Protreon Inc. from any and all liability arising from incidents, accidents, injuries, or disputes.
4. Pet Care & Animal Risk
- Caregivers and pet owners acknowledge that animals can behave unpredictably and may pose a risk of injury or damage.
- Clients are responsible for disclosing any known medical, behavioral, or aggression-related issues before confirming a booking.
- Caregivers are responsible for exercising reasonable care and avoiding negligent handling of pets.
5. Child Care & Household Safety
- Parents and guardians must provide caregivers with accurate care instructions and disclose any medical or behavioral conditions.
- Caregivers agree to act responsibly and maintain a safe environment for children.
- KobiCare is not liable for child injuries, household damages, or negligence occurring during care.
6. Property Damage & Theft
- KobiCare is not responsible for lost, stolen, or damaged property resulting from caregiver or client actions.
- Users are advised to secure valuables and document any incidents to resolve disputes directly between parties.
7. Dispute Resolution
- KobiCare may assist in facilitating communication between users but does not arbitrate or guarantee outcomes.
- All disputes between users must be resolved independently, unless otherwise required by law or court order.
8. Indemnification
- You agree to indemnify, defend, and hold harmless KobiCare, Protreon Inc., its officers, directors, and employees from any claims, losses, damages, or legal actions arising from your use of the platform or services.
