These Terms and Conditions (“Agreement”) govern your use of the KobiCare.com website and services, which are owned and operated by Protreon Inc. (“KobiCare,” “we,” “us,” or “our”). This Agreement is a legally binding contract between KobiCare and you (“you,” “user,” “caregiver,” or “customer”). By accessing or using our website or mobile applications (collectively, the “Platform”), you agree to be bound by these Terms.

1. Eligibility

• You must be at least 18 years old.
• You must have full legal authority to enter into this agreement.
• You must not be barred from using our platform under any applicable law.
• We reserve the right to refuse access or service to anyone, at our sole discretion.

2. Description of Services

• KobiCare is a marketplace platform that connects:
• • Pet owners and parents (“Customers”) with independent caregivers (“Caregivers”).
• We facilitate the connection, scheduling, messaging, and payment, but do not directly provide pet or childcare services.
• All caregivers operate as independent contractors, not employees, agents, or representatives of KobiCare or Protreon Inc.

3. Background Checks & Vetting

• KobiCare may conduct background checks, ID verification, and screening at its discretion.
• We do not guarantee the accuracy or completeness of any screening or information presented by users.
• You are responsible for your own due diligence when engaging with other users.

4. Independent Contractor Status

• Caregivers on KobiCare are independent professionals.
• KobiCare does not supervise, direct, or control their work.
• Caregivers are solely responsible for complying with all legal, tax, insurance, and licensing requirements.

5. Payments & Fees

• Customers agree to pay for booked services in advance.
• KobiCare retains a service fee from each transaction.
• Cancellations, refunds, and chargebacks are subject to our Cancellation Policy.

6. User Conduct

• You agree not to post false information, harass other users, use the platform unlawfully, or upload harmful code.
• We reserve the right to suspend or terminate accounts for violations.

7. Insurance & Liability

• KobiCare does not provide liability, medical, or accident insurance for services rendered.
• Caregivers should maintain their own liability insurance.
• We are not responsible for injury, loss, theft, or misconduct by users.

8. Limitation of Liability

• KobiCare disclaims all liability for indirect, incidental, or consequential damages.
• Our total liability to you will not exceed $100 or the amount paid by you in the past 12 months.

9. Disclaimer of Warranties

• The platform and services are provided 'as-is' and 'as-available'.
• We make no warranties regarding accuracy, uptime, or suitability of services.

10. Intellectual Property

• All content is owned by Protreon Inc. or licensed to us.
• You may not copy, distribute, or misuse our content.

11. Privacy Policy

• KobiCare complies with GDPR, CCPA/CPRA, and COPPA.
• Children under 13 cannot use our platform.

12. DMCA & Copyright

• To report infringement, email legal@kobicare.com with your contact info, work description, URL, and sworn statement.

13. Termination

• We may suspend or terminate accounts at any time.
• Termination does not waive prior obligations or liability.

14. Dispute Resolution

• Disputes must be resolved through negotiation or binding arbitration in Florida.
• You waive the right to a class-action lawsuit or jury trial.

15. Indemnification

• You agree to indemnify KobiCare and Protreon Inc. against claims from your use of the platform or violation of terms.

16. Changes to Terms

• We may modify these terms at any time.
• Continued use after changes means you accept the new terms.
